Lucky Fried Gains LLC operates code-config.com. Users publish their own material through Community, and we respond to copyright notices about that material under the Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to send a notice, what we do with it, and how a publisher responds.

1. Sending a copyright notice

Send your notice by email to copyright@code-config.com with the subject line “Copyright notice”.

To be effective under 17 U.S.C. § 512(c)(3), your notice includes:

1. a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
2. identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single location are covered by one notice, a representative list of those works;
3. identification of the material that is claimed to be infringing and that is to be removed or to have access to it disabled, with information reasonably sufficient to let us locate that material — a link to the Community page is the most direct form;
4. information reasonably sufficient to let us contact you, such as an address, a telephone number, and an email address;
5. a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

A notice that omits these elements may be ineffective, and we may ask you to supply what is missing. Misrepresenting that material is infringing carries liability for damages under 17 U.S.C. § 512(f).

2. What we do with a notice

We review each notice we receive. Where the notice is effective, we remove the identified material or disable access to it, and we notify the user who published it, passing on the notice so that user can respond. We keep a record of the notices we act on.

3. Counter-notice

A user whose material was removed or disabled may send a counter-notice by email to copyright@code-config.com with the subject line “Copyright counter-notice”.

To be effective under 17 U.S.C. § 512(g)(3), a counter-notice includes:

1. a physical or electronic signature of the user;
2. identification of the material that was removed or disabled and the location at which it appeared before it was removed or access to it was disabled;
3. a statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
4. the user's name, address, and telephone number, a statement that the user consents to the jurisdiction of the United States District Court for the judicial district in which that address is located — or, if the address is outside the United States, any judicial district in which Lucky Fried Gains LLC may be found — and a statement that the user will accept service of process from the person who sent the notice, or from an agent of that person.

When we receive an effective counter-notice, we forward it to the person who sent the original notice. Unless that person informs us that they have filed an action seeking a court order to restrain the user from the activity at issue, we may restore the material in 10 to 14 business days after we forward the counter-notice.

4. Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly publish infringing material. Accounts that repeatedly publish infringing material may be terminated, and the material published from them may be removed.
